Indian Incentive Program

The federal government encourages prime contractors to partner with Native American-owned companies through the Indian Incentive Program (25 U.S.C. §1544). This program provides prime contractors with a financial incentive of up to 5% of the amount paid to qualifying Indian-owned subcontractors like Prairie Band Construction.

To receive this incentive, the prime contract must include the appropriate authorization clause, and the incentive payment is subject to appropriated fund availability. For Department of Defense contracts, the DFARS Clause 252.226-7001 must be included in the prime contract for eligibility.

Prairie Band Construction is certified in the U.S. Small Business Administration's 8(a) Business Development Program, which provides significant contracting advantages for tribally-owned firms:

Streamlined Sole-Source Contracting

The 8(a) sole-source vehicle eliminates the traditional procurement process, bypassing market research, competitive solicitation, proposal evaluation, and source selection. This streamlined approach reduces acquisition time from months to days, allowing projects to commence rapidly.

No Dollar Limit on Sole-Source Contracts

Unlike individually-owned 8(a) firms that face a $4.5 million sole-source threshold, tribally-owned 8(a) participants like Prairie Band Construction have no dollar limit on sole-source contract awards. As of 2025, federal agencies can award sole-source contracts to tribal 8(a) firms up to $30 million (non-DoD) or $100 million (DoD) without requiring justification and approval documentation.

Limited Protest Opportunities

Under 13 CFR §124.517(a), the eligibility of an 8(a) participant for contract award cannot be protested, providing greater procurement certainty and faster project initiation. Prairie Band Construction's experienced technical and managerial personnel can begin delivering contracted services immediately upon award.
